Booking Terms and Conditions
1. Contracts
1.1 The Contract is between Dhathuru Maldives and the person(s) making the booking (‘The Client’) which expression includes all persons on whose behalf the booking is made. Their liability to Dhathuru Maldives is joint and several.
1.2 No contract shall exist until a signed booking form has been received by Dhathuru Maldives with payment of the booking deposit or the full amount of the booking as required by Dhathuru Maldives.
1.3 Telephoned bookings must be confirmed in writing.
1.4 Dhathuru Maldives will issue to the Client written confirmation of the booking but The Client must check carefully the written confirmation & report any error or omission immediately upon receipt of the confirmation.
1.5 No alteration to these Terms & Conditions may be made except in writing & signed on behalf of Dhathuru Maldives.
1.6 Dhathuru Maldives is a travel agency service arranging total travel solutions to destinations featured in the Dhathuru Maldives Port folio. Dhathuru Maldives is not an owner of any resort, hotel and motel or live aboard and so does. Responsibility for the properties, accommodation and transport is with the organizers who are independent & separate from Dhathuru Maldives.
1.7 As a responsible travel agency Dhathuru Maldives maintains a trust account where The Client’s money (paid in advance) is kept accordingly with the cancellation policy until the guest(s) departure from the destination.
1.8 This contract is governed by Maldivian law and the Maldivian courts shall have exclusive jurisdiction to decide any interpretation of it’s terms or any dispute arising from them.
1.9 The clauses in these TERMS AND CONDITIONS shall be severable; this means that if a court or arbitrator decides that one or more of the clauses is defective then this does not affect the validity of the other clauses.
2. Payment
2.1 Full payment in United States Dollars, less any deposit pre-paid shall reach Dhathuru Maldives at least 8 weeks before the departure date stated on the booking form.
2.2 The Client is responsible for payment being made in full for all persons stated on the booking form (or any written variation of the form).
2.3 If payment is not made as required, Dhathuru Maldives reserves the right to cancel the booking, retain the deposit and make a cancellation charge. This is calculated as a percentage of the total holiday cost, as follows:-
- Notification given Cancellation charge
- More than 4 weeks Deposit
- Within 4 weeks 100% of Holiday Price
3. Prices
3.1 All prices are quoted in United States Dollars.
3.2 Dhathuru Maldives reserves the right to increase/reduce advertised prices before the booking is accepted. The correct price will be notified on the booking form at the time of acceptance of the booking.
3.3 Dhathuru Maldives reserves the right to charge The Client in addition to the amount(s) on the booking form all VAT and government taxes both Maldives and foreign where those taxes are levied on Dhathuru Maldives. The Client may cancel the booking if done within 14 days from the date of the invoice issued by Dhathuru Maldives for the booking.
3.4 Dhathuru Maldives will endeavour to notify “The Client” of taxes being levied or fluctuations in currency, other credit facilities & banking charges as soon as possible but Dhathuru Maldives shall not be liable for any adverse effect of these upon “The Client”.
3.5 If The Client wishes to cancel or change the booking because of the above Dhathuru Maldives will endeavour to accommodate the change BUT any changes within 8 weeks of the departure date stated on the booking form will be treated as a cancellation.
4. Alterations by Dhathuru Maldives
4.1 As bookings are (often) made many months in advance of the departure date changes can occur. Dhathuru Maldives reserves the right to make alterations to holiday/brochure details before and after bookings are accepted.
4.2 Dhathuru Maldives will advise of changes as soon as possible.
4.3 Dhathuru Maldives will not be liable for compensation or a refund of the booking cost for minor changes but for major changes:
(a) The Client will have a choice to accept the change(s);
(b) The Client may purchase another holiday from Dhathuru Maldives & pay or receive any price difference;
(c) The Client can cancel the holiday and receive a full refund minus any insurance premiums paid.
4.4 Dhathuru Maldives will pay compensation for a major change except where caused by circumstances beyond the control of Dhathuru Maldives or circumstances that could not be foreseen, examples of which are war, threat of war, terrorist activity, riot, civil commotion, industrial action, fire, natural or nuclear disaster, adverse weather conditions & circumstances amounting to force majeure.
4.5 Dhathuru Maldives reserves the right to cancel The Client’s booking in any circumstances and all our bookings operate subject to a minimum number of participants.
4.6 Dhathuru Maldives will not cancel a booking less than 4 weeks before the departure date except by reason of force majeure or because The Client has not paid the final invoice.
5. Insurance & Injury
5.1 It is a condition of a booking being accepted that The Client will provide a suitable travel insurance policy for the trip, and take care to ensure that it does cover all the activities that are part of the trip.
5.2 We have arranged with Competition Car Insurance that a suitable policy be available from ourselves, and full details are available on request. If you are not taking advantage of our insurance please provide full details of your alternative cover including Insurers name, policy number(s) and emergency medical help-line number.
Dhathuru Maldives reserves the right to inspect The Client’s travel insurance documents.
5.3 Dhathuru Maldives cannot accept responsibility for injuries or loss caused to The Client through an occurrence that happened when the Client was holidaying. The Client must use their own care & attention when holidaying. The Client must therefore holiday at the Clients own risk.
5.4 Dhathuru Maldives accepts responsibility for the acts/omissions of its staff, agents, suppliers & sub-contractors where they are acting within the scope of their contract with RT except that in the case of services provided by air or sea carriers or hoteliers RT’s liability is limited as if RT were carriers/hotel keepers within the terms of International Conventions.
5.5 Except in the case of death, bodily injury & illness Dhathuru Maldives’s liability is limited to the total price of the booking as stated on the booking form.
5.6 Dhathuru Maldives has no responsibility for death, bodily injury & illness where that is caused by a third party not connected with the booking &/or where Dhathuru Maldives could not have foreseen or forestalled the occurrence giving rise to the death, bodily injury or illness.
5.7 Dhathuru Maldives shall have no liability for loss/damage to luggage or personal belongings (including money) as The Client is required to obtain minimum insurance cover for these before departure date. In excluding liability Dhathuru Maldives says it is reasonable to require The Client to obtain insurance cover for these.
5.8 In the case of claims on Dhathuru Maldives within the International Conventions The Client is required to notify to Dhathuru Maldives each claim in writing within 21 days of The Client’s return from the trip for which the booking was made, & The Client will be required to assign to Dhathuru Maldives or its insurers any rights The Client may have against third parties as well as giving Dhathuru Maldives &/or its insurers all assistance necessary.
5.9 Dhathuru Maldives’s liability will not exceed any limitation applicable under the International Conventions.
6. Travel Delays
Dhathuru Maldives will not be liable for loss that occurs from The Client arriving late or being delayed at any airport or seaport or any road or railway.
7. Valid Documents
The Client is responsible for obtaining all valid documents necessary for the travel & holiday before the departure date such as passport(s), visa(s), vaccination certificate(s) & other health certificate(s).
8. Disability
Dhathuru Maldives will use best endeavours to make arrangements for people suffering from disability (physical or mental) or other problems of fitness or health but as Dhathuru Maldives is a travel agency it cannot be responsible for the policy or the acts/omissions of suppliers of accommodation& transport services, whether in the Maldives or elsewhere.
9. Brochure Information
The information contained within the Dhathuru Maldives brochure is correct to best of our knowledge at the time of the brochure going to print. However, the client should bear in mind that in relation to the information given about the resorts and certain of the facilities we cannot guarantee accuracy at all times or that any particular activity will take place as these services are not under our control.
10. Behaviour by The Client
10.1 The cost of damage & breakages will be charged to The Client& must be paid before the end of the travel/holiday. The Client undertakes to behave & not to cause inconvenience to others or harm the reputation of Dhathuru Maldives or those providing services to The Client or to Dhathuru Maldives.
10.2 Dhathuru Maldives reserves the right to enforce The Client’s undertaking & claim from The Client re-imbursement of all losses & costs incurred as a result of The Clients failure to honour the Undertaking.
11. Our liability to The Client
Dhathuru Maldives accepts full liability for the proper performance of Dhathuru Maldives’s obligations under the Contract. If The Client has a justified complaint about any of Dhathuru Maldives’s services, Dhathuru Maldives will pay reasonable compensation. If the client suffers damage by Dhathuru Maldives’s failure to perform, or Dhathuru Maldives’s improper performance of, The Contract then Dhathuru Maldives accepts liability except in the following circumstances:-
(a) If the failure or improper performance is the fault of The Client;
(b) If the failure is the fault of someone else not connected with the provision of the services which make up the holiday which Dhathuru Maldives has confirmed to The Client;
(c) Any unusual & unforeseeable circumstance beyond Dhathuru Maldives’s control, the consequences of which could not have been avoided even if all due care had been exercised;
1) except in cases of personal injury, Dhathuru Maldives’s liability will not be more than the price of the holiday of the person making the claim against Dhathuru Maldives; and
2) Dhathuru Maldives’s liability will not exceed any limitation applicable under any International Conventions governing or relating to the provision of the service complained of, even if that convention has not been ratified by or applied in the United Kingdom.
12. Accommodation
The Accommodation provided is only for the use of clients shown on the booking form & therefore subletting, sharing or assignment is prohibited.
13. Complaints Procedure
If the Client has a complaint while The Client is on holiday, The Client must tell Dhathuru Maldives’s representative or agent & the appropriate supplier immediately. With The Client a report will be completed giving details/actions to resolve. Copy of this will be given to The Client, & on completion of holiday the client must write to Dhathuru Maldives within 21 days if The Client wishes to pursue things further completing all necessary paperwork.
